General Terms and Conditions

We invite you to read this document carefully as when sending any orders you will be asked to declare that you have read and accepted it. The Conditions of Sale reported here regulate the offer and sale of products on the website www.mado1984.com

ORDER ONLINE

The online order determines the acceptance of the terms and conditions reported here and constitutes a contract between the Buyer and mado1984.com, who must be an adult, for the purchase of the products listed in the online catalogue of the website mado1984.com.

mado1984.com may modify, without prior notice, the General Conditions. Such modifications will be effective from the day of their publication on the Site. The General Conditions in force at the time of conclusion of the sales contract will be applied to purchase orders forwarded to mado1984.com before the publication of the aforementioned modifications.

Purchases made on mado1984.com are regulated, for anything not expressly provided for in the following purchase conditions, by Legislative Decree no. 185 of 22 May 1999 relating to the protection of consumers in matters of distance contracts.

PRODUCT FEATURES ONLINE

The characteristics of the products are indicated in the online catalogue and are visible at the time of selection and compilation of the order before the conclusion of the forwarding procedure.
Prices (including VAT and all other taxes and duties for Italy) are indicated next to each product in the online catalogue, excluding shipping costs (except for the “Free Shipping” promotion periods). mado1984.com is not responsible for packaging of a different colour and/or screen printing made by the manufacturing company following packaging change operations.

The visual representation of the Products on the Site, where available, generally corresponds to the photographic image of the same and has the sole purpose of presenting them for sale, without any explicit or implicit guarantee or commitment, on the part of mado1984.com, regarding the exact correspondence of the image depicted on the Site with the actual product, especially with regard to its dimensions and/or the chromatic aspects of lenses and frames.

The offer of Products and Services mado1984.com is aimed at both consumer users and other users. Consumer users are those who purchase the Products presented on the Site for purposes other than any entrepreneurial or professional activity they may carry out in accordance with the provisions of Legislative Decree no. 206 of 6 September 2005 (the “Consumer Code”).

For the purposes of these General Conditions, anyone who, when purchasing a Product or Service, expressly indicates in the personal data notes that they belong to the category "Companies, entities, professionals holding a VAT number", simultaneously entering their VAT number, is not considered a Consumer.

Where no express reference is made to the Company category, the provisions of the General Conditions and the Specific Conditions apply without distinction to all users who purchase Products through the Site who are Consumers.

Companies have various consumer rights and guarantees.

PRODUCT PRICE

The prices published on the homepages or in the various sections of the Site dedicated to each individual Product include VAT and do not include any taxes, duties and charges applicable in the country of destination of the Products where this is different from Italy. These costs, which vary from country to country, are the responsibility of the Customer, who is responsible for verifying the amount with the competent customs authorities.

The cost of each shipment must be added to the price of the individual Product, the amount of which may vary based on the delivery and payment method, as well as in relation to the country of destination. The total amount due for the selected Products will be clearly indicated and communicated to the Customer, before the conclusion of the Sales Contract.

The Prices shown on the Site are subject to possible variations and/or modifications by mado1984.com without any obligation to give prior notice to the Customer. Said increases may depend – among other things – on increases decided by the suppliers of mado1984.com. The prices in force at the time of receipt of the Order will apply to Sales Contracts concluded before the publication of the aforementioned modifications, but still in progress.

CONTRACT CONCLUSIONS

At the moment the order is transmitted by the Buyer to mado1984.com, the contract of the General Conditions of Purchase will be considered accepted and binding.

mado1984.com may therefore send the FINAL CUSTOMER a refusal of the order and reserves, at its sole discretion, the right to cancel any order in the event of material errors connected with the Customer's order or with the information sent by the Customer via the site: mado1984.com. (E.g. Price of the selected Product visibly incorrect, non-existent e-mail address, etc.)

Once the Order has been received, mado1984.com sends the Customer a confirmation email containing the Order details and all the data relating to the purchase, i.e. the type of Products requested and the related costs, as well as the Customer's personal data and contact details.

The Customer undertakes to verify the accuracy of his/her personal data and to promptly communicate any changes to mado1984.com. Receipt of the e-mail confirms the Customer's reading and acceptance of the General Conditions and the Specific Conditions.

Once mado1984.com has received acceptance of the Order, the latter will arrange for the shipment of the selected Products, which will be communicated to the Customer via email.
